myVal™ App Terms and Conditions

1. Introduction

Welcome to the myVal™ app (the “App”). By accessing or using the App, you agree to be bound by these Terms and Conditions (the “Terms”). If you do not agree with these Terms, please do not use the App.

2. Purpose of the App

The App is designed to assist users in valuing household contents for insurance purposes by providing estimates of item values. The App’s valuations are intended to serve as a reference and should not be considered as definitive or binding assessments of actual value.

3. User Responsibilities

By using the App, you agree to:

  • Provide accurate and complete information when prompted by the App.
  • Use the App in accordance with applicable Australian laws and regulations.
  • Ensure that the App is used solely for personal purposes and not for any commercial or fraudulent activity.

4. Valuation Disclaimer

The valuations provided by the App are estimates based on available data and algorithms. These estimates:

  • May not reflect the actual value of your household contents.
  • Are not intended to replace professional appraisals or insurance evaluations.
  • Should be used as a guideline only.

Important: For accurate limitations and coverage details, you must consult your Product Disclosure Statement (PDS) or contact your insurer directly.

5. Insurance Coverage

The App does not provide insurance coverage, nor does it serve as an insurance policy. Users are responsible for securing appropriate insurance coverage based on the valuations provided by the App. The App makes no representations or warranties regarding the sufficiency of insurance coverage based on the estimates provided.

6. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (ACL) or any other applicable law that cannot be excluded, restricted, or modified by agreement.

To the extent permitted by law, our liability for breach of any guarantee, condition, or warranty implied by law that cannot be excluded is limited, at our option, to:

  • The resupply of the services; or
  • The payment of the cost of resupply of the services.

7. Privacy and Data Security

Your privacy is important to us. By using the App, you consent to the collection, use, and storage of your data in accordance with the Australian Privacy Principles (APPs) and our Privacy Policy. The data collected will be used solely for the purpose of providing valuation services and will not be shared with third parties without your consent, except as required by law.

8. Limitation of Liability

To the fullest extent permitted by law, myVal™ and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the App.
  • Any unauthorized access to or use of our servers and/or any personal information stored therein.
  • Any interruption or cessation of transmission to or from the App.

9. Intellectual Property

All content, trademarks, and data on the App, including software, text, graphics, logos, and images, are the property of myVal™ or its licensors and are protected by Australian copyright, trademark, and other intellectual property laws. You may not use, copy, reproduce, or distribute any of this content without prior written permission from myVal™.

10. Modifications to the Terms

We may revise these Terms from time to time. If we make significant changes, we will provide you with notice through the App or by other means. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

11. Governing Law and Dispute Resolution

These Terms and your use of the App shall be governed by and construed in accordance with the laws of the Commonwealth of Australia and the state of New South Wales.

Any disputes arising out of or relating to these Terms or the App shall be resolved through negotiation in good faith. If a resolution cannot be reached, the dispute will be submitted to mediation before resorting to any other means of dispute resolution.
